New York State Revenge Porn Law

After five years of campaigning, networking, letter-writing, Twitter rants, screaming from rooftops, in July 2019, THE NEW YORK STATE REVENGE PORN LAW WAS SIGNED! Revenge Porn is a Class A misdemeanor in New York state!

So, what does this mean?

  • Offenders can get up to a year in jail
  • Offenders can be fined up to $1000
  • You can sue the perpetrator for money $$$
  • Judges can order both offenders and websites to take content down (NY is the only state in the nation to empower judges in this way!)
  • You can file for workplace harassment if the offender was a colleague

This law is a HUGE step forward for victims. Of course, we wouldn’t have these new rights without the help of tireless advocates like Assemblyman Ed Braunstein and Senator Monica Martinez and others who fought to make this bill a reality. You can read the full text here on the NY senate website.

  • “Revenge porn is a pervasive problem that often results in victims being threatened with sexual assault, stalked, harassed, or fired from jobs,” said Assemblyman Braunstein. “Victims have committed suicide due to the severe emotional pain caused by the disclosure of their intimate photos. The passage of this legislation sends a strong message that individuals who engage in this type of reprehensible behavior will be held accountable for their actions.”
  • “In my work on the legal team at C.A. Goldberg, with the Cyber Sexual Assault Taskforce, and in my personal experience of abuse, I have seen the devastating impact of non-consensual image distribution. The sheer terror the offender inflicts, the complete sense of violation. It is catastrophic and life-altering. So I’m glad to see that New York state is taking cyber sexual assault seriously. I can’t wait to use this new law to help others get justice.”-Annie Seifullah, Attorney at C.A. Goldberg, PLLC, co-chair of the Cyber Sexual Assault Task Force, and image abuse survivor/warrior
