Super Lawyers, June 24, 2025 (UPDATED)
Rebecca Mariscal
This article covers how state laws can protect victims of image-based sexual abuse, also known as “revenge porn,” and specifically covers the details of New York state law. Not every state has both a criminal and civil law for “revenge porn” but New York makes these non-consensual disseminations a class A demeanor and provides a civil route for victims to sue offenders. Providing her legal expertise around “revenge porn,” Carrie shares how important it is to hold tech platforms and search engines accountable for the dissemination of intimate images and videos, and that holding them accountable and eliminating immunity will be a key part of the solution moving forward.
“One of the most important things about these laws is that it’s a public signal that we in New York don’t tolerate expressing oneself through the nude image of another person.” — Carrie Goldberg
“It can be humiliating when somebody is peddling your most private, intimate moments. However, this too shall pass and it’s important to surround yourself with a team of people. And that means loved ones and supporters and lawyers who can help you get through this storm.” — Carrie Goldberg
“There are tools in our legal system—and that’s civil, criminal, copyright, order of protection—that are designed and have been tried and tested to get victims justice and to get them through the problems as fast as possible.” — Carrie Goldberg
