Lawsuit challenges New York’s handling of a rape complaint made decades ago

Our firm filed a lawsuit on behalf of our client Elizabeth Crothers for the mishandling of her rape complaint made in 2001 against Senior Assembly aide Michael J. Boxley. The internal investigation by the New York State Assembly failed to reach a conclusion, effectively ostracizing the complainant, our client. Through our lawsuit, another victim has gone public with her previous complaint against Boxley. Back in 2003, a legislative aide, Rikki Shaw, accused Boxley of rape, and he pleaded guilty to a misdemeanor sexual-misconduct charge, receiving probation and registering as a sex offender. 

Our lawsuit is being brought under the Adult Survivors Acts’ look-back window and contends that by publicly backing Boxley after the earlier report, Assembly leadership signaled the complainant was not credible. If our client’s case goes to trial, Shaw says she plans to testify. 

We are proud to represent Elizabeth Crothers, who fought hard as hell with the Sexual Harassment Working Group to get the ASA passed for all victims of sexual assault in New York.
