Washington Cases To Watch In 2026

Law360 reported that among the most anticipated rulings expected in 2026 is the Washington Supreme Court’s decision in our cases brought against Amazon.com Inc. by the families of those young people who died by suicide after ingesting high-potency sodium nitrite purchased via Amazon.

As background, on November 25th, 2024, the Division One Court of Appeals in Washington reversed our wins in Scott v. Amazon and Viglis v. Amazon, relying on century-old precedent. Well, we didn’t stop. We petitioned the Washington Supreme Court (WASC), which agreed to hear the case, and on September 9th, we presented our arguments to WASC. The outcome will determine the future of Scott/Viglis and the 24 remaining Families’ cases. Amazon must be held accountable for the deaths of our 28 clients. We anxiously await the ruling – send warrior vibes!

CAG Comments on the ‘Grok Bikini Trend’

Before filing our lawsuit against xAI (see below!), Grok was all over the news for flooding X with sexualized images of women, dubbed as the ‘Grok bikini trend.’ The images, created using Grok, have prompted a major outcry and widespread concerns around the lack of AI guardrails and safety. Carrie weighed in and spoke with several news outlets on this absolute disgusting invasion of privacy and nonconsensual dissemination of images at the hands of an unmonitored, unregulated tech platform. Goldberg v Grok: Lawsuit Coverage

On January 15, 2026, we filed a lawsuit in NY on behalf of Ashley St. Clair against xAI, after its AI chatbot Grok created and disseminated deepfakes of women and children throughout the world, including of St. Clair. The case has garnered attention across the globe.

St. Clair reported various images to X and requested their removal, and while Grok first promised St. Clair that it would refrain from manufacturing more images, the company retaliated against her, demonetizing her X account and generating multitudes more images of her. xAI is directly liable for the harassment and explicit images created by chatbot Grok.

We are suing X for negligence and product defects.  And we are also taking the novel approach of suing it as a public nuisance. St. Clair’s goal is to protect the world from tech companies unleashing these sexually abusive capabilities into the stream of commerce and we are proud to be her attorneys.

The Education Department is opening fewer sexual violence investigations as Trump dismantles it

Before the Trump administration began dismantling the Education Department, it played a major role in enforcing protections against sexual violence in schools and universities. But with mass layoffs gutting the Office for Civil Rights, staffing was cut in half, and a backlog of 25,000+ discrimination cases left the agency unable to hold schools accountable. As a result, investigations into sexual violence have dropped at a terrifying rate – from dozens per year to fewer than 10 nationwide. In response to reporting that many firms handling Title IX cases have stopped filing complaints, our Associate Katie McKay provided comments.
